Adoption
The Child and Adolescent Statute in Brazil is governed
by the provisions of the Law nš 8069 of July 13, 1990, articles
39 to 52. The adoption process is attributed exclusively to the
Judiciary.
The adoption will be preceded by a trial period
of common living with the child or adolescent. The duration of
the trial period will be determined by the judicial authority.
In the case of adoption by foreigners resident and domiciled
outside Brazil, the trial period of common living to be completed
in Brazil will be a minimum of 15 days in the case of children
up to 2 years and 30 days when the child is 2 or older. This
requirement may be waived if the child is not older than 1 or
if, independent of age, the child has been in the company of
the adopting party for a period of time sufficient to evaluate
the convenience of the adoption bond.
It is advisable that the interested party be assisted
by a private specialized lawyer in Brazil. The Embassy does not
indicate institutions or lawyers in Brazil for this purpose.
In the case of an adoption requested by a foreigner resident
and domiciled outside Brazil, the candidate must corroborate,
by means of a document issued by the proper authority of his
domicile, to be duly qualified for the adoption according to
the laws of his own country, as well as present a psycho-social
study done by a specialized and accredited agency in the country
of origin. Brazilian authorities may require the presentation
of the text of the pertinent foreign legislation and proof of
its validity.
Documents in language other than Portuguese must
be accompanied by the translation, done in Brazil by a certified
public translator. All documents to be presented in Brazil by
the applicant must be previously legalized by the Embassy having
jurisdiction over the Province in which they were issued. At
the time of legalization, the adopting party should bring documents
to the Embassy in person for a brief interview.
The child to be adopted
will not be allowed to leave the country before the end of the adoption process.
